Bury Neighbourhood Plan

Bury Neighbourhood Plan

Bury Parish Council (BPC) has prepared a Neighbourhood Development Plan (NDP) for Bury. Further details are available on the Bury Parish Council website.

The following stages and documents have been completed.

Statutory stage Further information & documents
Plan “Made” (Adoption) The Bury NDP – i.e., the Submission Plan incorporating the Examiner’s modifications and all other modifications as per the Decision Statement – complies with the legal requirements and basic conditions set out in the Localism Act 2011 and, as a result of the SDNPA resolution on 12 April 2018, has been made.

The Bury NDP is part of the Development Plan for the parish as defined by the Neighbourhood Area designated on 12 December 2015.

The Bury NDP can be viewed at the following location:

  • South Downs Centre, North Street, Midhurst, West Sussex, GU29 9DH.
Referendum

A referendum was held on the Bury NDP on 01 March 2018. Further information on the referendum is available on the Chichester District Council website.

There was a 38% turnout, with the following results:

  • Yes = 90.6% (455 votes)
  • No = 9.4% (109 votes)
Decision Statement The SDNPA agreed the Proposed Decision Statement for the Bury NDP on 17 November 2017.  The proposed statement accepted all modifications set out in the Examiner’s Final Report except for two minor variations as follows:

  • NDP Policy 3 – Minor variation to the wording in relation to the allocation for new housing to allow for greater flexibility in how the site comes forward.
  • NDP Policy 8 – Retention of the designation of the Wharf and Common Land as a Parish Heritage Asset.

As per the Neighbourhood Planning (General) Regulations 2012 (as amended), if a local planning authority proposes to make a decision which differs from the Examiner’s recommendations, then it must notify the qualifying body, consultation bodies, and all those who made a representation to the Examiner about their proposed decision (and reasons for it) and invite representations on the variations. 

The closing date for representations was 12 January 2018.  No objections were received during the period for submitting representations, and Historic England supported the retention of the designation of the Wharf and Common Land as a Parish Heritage Asset.

The SDNPA agreed the Final Decision Statement for the Bury NDP on 15 January 2018This sets out the modifications that were made to the Bury NDP prior to referendum.

Independent Examination  The SDNPA appointed Mr John Slater MRTPI as the Independent Examiner of the Bury Neighbourhood Development Plan (NDP).  The Examiner published their final report in October 2017.

Regulation 16 – Submission Consultation

The SDNPA published the Submission Bury Neighbourhood Development Plan (NDP) for consultation between 12 July and 23 August 2017.

      Regulation 14 Bury Parish Council (BPC) carried out a pre-submission consultation on the Draft Bury Neighbourhood Development Plan (NDP) between 12 November and 24 December 2016.
      Designated Neighbourhood Area A consultation on an application to designate the Bury Neighbourhood Area was carried out between 09 September and 21 October 2015.  The SDNPA designated the Bury Neighbourhood Area on 12 December 2015
